Terms of Use of Blackbyte Free Speech

These are the terms of use, for any user of Blackbyte Free Speech and other services of Blackbyte Networks.

Blackbyte Networks provides to its users certain services, such as Blackbyte Free Speech. These are services provided on an "as is" basis.

Free Speech provides an unblocking service for VoIP services such as Skype and others. While Blackbyte Networks has developed and deployed as Blackbyte Free Speech sophisticated obfuscation technology to unblock voip/skype, Blackbyte Networks does not guarantee unblocking of voip/skype. What Blackbyte Networks guarantees is only best effort done on its part to unblock voip / skype, and it is entirely possible that the ISP develops a better technology to detect and block Blackbyte Free Speech. Thus, a user may not hold Blackbyte Networks liable if voip / skype services are not available to him/her even while using Blackbyte Free Speech.

It is possible that use of Blackbyte Networks' services may be illegal in certain countries / jursidctions. It is entirely the users' responsbility to find out about the legal status of the use of Blackbyte Networks' services. The user is not to use Blackbyte Networks' services in case it is unlawful to use them. In no case will the user hold Blackbyte Networks liable for any illegalities committed arising out of the use of Blackbyte Networks' services. In any case, the liability of Blackbyte Networks will not exceed the subscription price paid by the user for the use of Blackbyte Networks' services.

Users are entirely responsible for keeping their userids/passwords of Blackbyte Networks' services secure. In no case will the user hold Blackbyte Networks responsible for issues arising out of other people using the Blackbyte Networks services out of theft of password or similar issues.

Use of Blackbyte Networks' services for criminal purposes is entirely prohibited. In any such use, Blackbyte Networks will reserve the right to communicate to the relevant authorities the details of the criminal activiities as per the law of the jurisidiction that applies. Also, any user committing a criminal act will lose the right to use Blackbyte Networks' services immediately, and his/her account will be either terminated or suspended for investigation and no refund will be granted to him/her in such a case.

Download of copyright protected material is strictly prohibited. Intellectual property theft will be treated as severely as any other criminal activity.

Blackbyte Free Speech allows a user to use upto 10 GB of bandwidth monthly. This includes "to and fro" bandwidth meaning the sum of upload and download bandwidth. This is a soft limit right now, and in case you are using bandwidth more than 10 GB, we will try to accomodate you provided this does not inconvenience other users. However, in the worst case, Blackbyte Networks reserves the right to limit the user to the above monthly limit. The bandwidth limit for the seven day trial period is 500 MB.

Privacy policy of Blackbyte Networks

Blackbyte Networks is a strong believer in privacy of the users. Blackbyte Networks does not look into users' data either manually or using any automatic tools, unless it is required to perform the service. For instance, Blackbyte Free Speech may in the future require to autmatically look at the data to figure out whether the data is voip/skype to unblock it. In such a case, no data will be stored or any parameters concerning the data will be stored except required to perform the service. Thus, the user can rest assured that his/her privacy is guaranteed. However, legal requirements may force Blackbyte Networks to keep logs of the users' use. In such a case, Blackbyte Networks will only keep logs as minimally required in the jurisdiction that is applicable. Any data of users asked of Blackbyte Networks by authorities will be given only if the authority follows legal procedures that are applicable in the relevant jurisdiction to which they apply. Any requests that do not have legal sanction by authorities will not be complied with. Further, Blackbyte Networks will endeavour to deploy its servers only in jurisdictions where the privacy laws are strong.

Change in Terms of Services

These terms of services can change any time without notice. Users are requested to frequently have a look at these terms which are also available on the Blackbyte Networks website (http://www.blackbytenetworks.com/terms_of_service.html). While Blackbyte Networks will notify users by email of any major changes in the Terms of Service, minor changes will not be notified. Acceptance of this agreement implies acceptance of any changes to the Terms of Services as and when they may be done.
