Terms of Use of Blackbyte Affiliate Program

These are the terms of use, for any one wanting to be part of the Affiliate Program of Blackbyte Networks.

Blackbyte Networks provides to its Affiliates certain services. These are services provided on an "as is" basis. As an affiliate, one can make a wholesale purchase of Black Byte Free Speech yearly subscriptions at a discount, and then resell them to end-users, herein called Black Byte Users. The price points at which the Affiliates can purchase the wholesale yearly subscriptions are published on the Black Byte website and can vary from time to time.

It is recommended that the Affiliates sell the yearly subscriptions to the Black Byte users at the retail price (price for buying a single yearly subscription mentioned in the Black Byte web site).

Affiliates are expected to resell the yearly subscriptions within a year of their purchase. Unsold yearly subscriptions will be null and void and no refund is payable for them.

In case of a refund to the Black Byte users for any reason whatsoever, the refund will be payable on a pro-rated basis to the affiliate and it will be pro-rated as per the price it was bought by the affiliate. It is the affiliate's obligation to pass on the refund to the end-user (Black Byte User).

Affiliates are to note down all details of the Black Byte Users to whom they resell the yearly subscriptions. This includes their valid identity and address. In case of any criminal activities performed by the end-users and if law enforcement needs to be contacted, affiliates are to provide the relevant details of the end-users as needed.

Other Affiliates Responsibilities:
Affiliates are expected to provide Black Byte Networks with accurate, complete and update registration information. Affiliates may not select the name or emailof another person with the intent to impersonate that person, or deceive anyone as to their true identity. Affiliates agree that Black Byte Networks may rely on any data, notice, instruction or request furnished to it by them which is believed by it to be genuine and to have been sent or presented by a person believed by it to be authorized to act on the affiliates' behalf.

Service and Support:
Affiliates of Black Byte Networks have no right to provide support to customers of the Site. Only Black Byte Networks may provide support to Black Byte Users. Also, affiliates are not beneficiary to any agreement between Black Byte Networks and a Black Byte User (end-user).

It is possible that use of Blackbyte Networks' services may be illegal in certain countries / jursidctions. It is entirely the affiliates' responsbility to find out about the legal status of the use of Blackbyte Networks' services. The affiliate is not to purchase Blackbyte Networks' services in case it is unlawful to use them. In no case will the affiliate hold Blackbyte Networks liable for any illegalities committed arising out of the use of Blackbyte Networks' services. In any case, the liability of Blackbyte Networks will not exceed the price paid by the affiliate for the purchase of Blackbyte Networks' services.

Userids and Passwords:
Affiliates are entirely responsible for keeping their userids/passwords of Blackbyte Networks' affiliate program secure. In no case will the affiliate hold Blackbyte Networks responsible for issues arising out of other people using the Blackbyte Networks affiliate services out of theft of password or similar issues.

Use for Criminal Purpose:
Use of Blackbyte Networks' services for criminal purposes is entirely prohibited. In any such use, Blackbyte Networks will reserve the right to communicate to the relevant authorities the details of the criminal activiities as per the law of the jurisidiction that applies. Also, any end user committing a criminal act will lose the right to use Blackbyte Networks' services immediately, and his/her account will be either terminated or suspended for investigation and no refund will be granted to him/her in such a case.

Change in Terms of Services
These terms of services can change any time without notice. Affiliates are requested to frequently have a look at these terms which are also available on the Blackbyte Networks website (http://www.blackbytenetworks.com/techno/affiliate_terms_of_service.html). While Blackbyte Networks will notify affiliates by email of any major changes in the Terms of Service, minor changes will not be notified. Acceptance of this agreement implies acceptance of any changes to the Terms of Services as and when they may be done.
